Insurance claim. Advice needed??(more info now included)

basically its about an insurance claim. If anybody might be able to give me advice please post back.

maybe i should of put more info. well here it is:

basically i had a lorry crash into me in may. totally his fault ( iwasnt even moving) he's from belgian so this always makes things abit more difficult.
well as it stands now he has admitted laibility so ur thinking well what problems have i got.
well heres the problem through a error of judgement i made the mistake of not paying legal fees ( didnt tick the little box) when a took my insurance out so now my insurance company are saying they will not get me my excess back and i have to do this myself. (£575 out of pocket)
so i was just wondering if anybody has any advice on how to do this??
the solicitor who is dealing with getting my insurance companies outlay is going to mail me all the 3rd party details etc so i should have all the information.
as i say its where i take it from there.

has anybody been in a similar situation??
