Silver Hardtop on ebay

I won the recent auction on ebay for the silver hardtop.  The guy was very difficult to contact, as he never answered his phone and took ages to respond to emails and messages.  Eventually I made arrangements to collect the hardtop from London.  As im having trouble with my soft top I had to rent a van for a day.

Once I had arrived at our meeting point I called him and he said he would be 45 mins.  2 hours later, no show.  During this time period I tried calling him on his mobile - no response!

So I had no option but to return home.  A 400 mile round trip for sweet FA.  s:cry: :cry: s:cry:  

I just thought I would share this with U all, and wondered if there is anything I can do?  I thought that when bidding you open a contract.  This guy said in the info on ebay that p&P was £60, and when i won the bid he said he could deliver.

Read the guys feedback on e-bay and you'll see he has a pretty poor history. Have you paid him?

Yeah, you do enter into a 'contract' when you win something on eBay, and both the buyer and seller have responsibilities to that, but at the end of the day there is no-one that is going to force the transaction. You can complain to eBay and they will badger him, but it generally doesn't lead anywhere unfortunately.
As Grant said, have you paid? If so, this could possibly be a criminal matter if he dissapears with your goods, and could possibly be followed up via the police. If you haven't paid and he doesn't want to play ball, then there isn't a lot you can  do  s:( :( s:(  
Leave negative feedback at least, it will help warn others (if he leaves negative on you, it can now be removed if you can prove a good reason as to why).

If you've paid out for this top, you need to act immediately. Police, army, credit card companies, the whole shooting match..

If you havent paid, then you should consider yourself lucky, but you still need to inform e-bay that they have a member engaging in possible criminal activity.

cheers guys for ur replies.  No i havent actually paid for the hard top.  I was going to pay via that paypal thing, but he told me his wasnt working!?!

I have given him a negative feedback comment, but there wasnt really enough room to explain things.  I have also emailed ebay, and explained the whole situation and referred to the other negative feedbacks he has recieved.  Hopefully they will get rid of him!

Iv told him that he can shove the hardtop were the sun dont shine, so im guessing that it will be readvertised soon.  So beware!

The guy who is selling the silver hardtop has emailed me and apologised as he lost his phone.  Doesnt explain why he didnt come and meet me where he was supposed to.

He has offered to deliver it to me.  What do you guys think?

Would avoid it/him like a bad smell if it was me in that situation - how much misfortune can one person have?  

Lost phone   s:roll: :roll: s:roll:  
Paypal not working     s:shock: :shock: s:shock:  
Accused of selling stolen gear    s:? :? s:?  

A question to ask yourself is - if you knew before you bid what you know now, would you have still gone ahead?

hmmm if you were going to go through it, i'd go through an escrow service,, he sounds suspect at best

Whilst I know that getting a hardtop is important to some - it was to me!

I'm not sure if I would pay this guy, if he can't turn up what's to say he will send it?

Why not contact the other buyers for the Porche & BMW hardtops who have given him good feedback & see if they........

a) collected
b) paid first
c) had any hassle - it's human nature to still leave good feedback even if the transaction didn't run smoothly

I emailed the guy who posted the negative response when this auction opened.

He said that the top he "won" turned out to be stolen and the police were involved.

I didn't add any more bids after that.

The buyer of the black hardtop on ebay, did'nt get his top either. He has just posted negative comment on ebay.
I'm thinking this is the black hardtop I looked at today in London, from ad on Findit.

You have got to wonder where this guy gets all of the ht's from, it's hard enough to find one but he has them on ebay all of the time  s:? :? s:?

There have been a few high profile court cases in Germany because of these problems. For example a dealer put a brand new car on sale starting at 1 euro for 3 days. It was sold for only a few thousand and the dealer backed out as the sum reached was not enough. The buyer took him to court and won. It has also been proven in court the other way around when a buyer tried to backout for some reason. The courts here have stated now that a bid is binding on both parties. E-bay also supports this.
